This sale is subject to the following terms and conditions: 1. Sale price $__________________ for Puppy only (do not add delivery fee) 2. DEPOSIT: Purchaser agrees to pay a non-refundable deposit of $1,000.00 by US Postal Money Order or Venmo (this is the only funds we accept). The Funds and Contract, must be delivered to Seller by overnight mail with the US Postal Service (no signature required at delivery) The balance is to be paid in full at the time of delivery of the Puppy in the form of Cash. Seller reserves the right to refuse the sale of said Puppy even upon delivery.

3.Replacement Of Puppy: a. If said Puppy has to be euthanized in the first 2 years of lifedue to a Genetic Defectthat surgery can not give said Puppy a quality of life, then a replacement Puppy will be given. Euthanization is not a option if surgery can give a quality of life. Even if the surgery is at a very high cost(Health Insurance Recommended). Purchasers Veterinarian must provide Seller with valid statement prior to euthanizing any Happy Bend Kennel Puppy. Sellers Veterinarian must concur with Purchasers Veterinarian that euthanizing said Puppy is the right decision. No euthanizing a Puppy/Dog just to get another Puppy for free, no matter what the cost of surgery, medication, physical therapy, ect... b. If a replacement Puppy is to be given, Purchaser is responsible for Delivery Transport fee to Seller.

4. Obligation Of Purchaser: a. Purchaser must have Puppy checked by Veterinarian on 3rd, or 4th. day of taking ownership of said Puppy. A fecal exam must be performed by Veterinarian at exam. Happy Bend Kennel is not responsible for any Veterinarian cost at any time. b. It is Mandatory that all Happy Bend Kennel Puppies be DeSexed after 14 months of age, and before 16 months of age (2 month window) No DeSexing before the age of 14 months of age. DeSexing before the allowed time will result in liquidation damages of $100.00 Per Day starting at day of DeSexing to age of 14 months (this is to protect my Puppies). Any Happy Bend Kennel Puppy not DeSexed by the age of 16 months will incur liquidation damages of $100.00 per day starting at the age of 16 months until said Puppy/Dog is DeSexed. c. It is mandatory for Purchaser to Mail Proof of DeSexing to Seller within 10 days of procedure, by same process as Deposit was mailed. (must have tracking as to not be lost in transit). d. Purchaser does not recieve Breeding Right with Puppy. Id Puppy/Dog is bred, purchaser will incur liquidation damages of $25,000.00 per breeding, this is to protect my Dogs. Liquidation Damages of $25,000.00 to be paid within 30 days of Puppies being born. e. After Purchaser takes ownership of Puppy, Clint Little will call on the first day and second day of Puppy in new home. This call must be aswered or returned very shortly (within 1 hour), this call is to check on the welfare of said Puppy. f. Purchaser agrees to not place Puppy on ground outside of the owners own lawn (due to Parvo) until the age of 13 weeks. 7 days after the 12 week of age Vaccination for Parvo, Puppy can be on ground at any location (dog parks not recommened). g. Purchaser agrees to not take Puppy from home on car rides other than to the Veterinarian for the first 7 days of said Puppy being in new home(due to stress). Purchaser agrees to not leave Puppy unatended for the first 96 hours in new Home(4 days) due to stress of being alone in new Home.

5. Hypoallergenic: a. Seller Guarantees said Puppy to not effect Family members with Dog Allergies. Purchaser has 6 hours for Family members to be around said Puppy to text for any Allergic reaction of said Puppy. All Family members with Dog Allergies must be present at the delivery location of Puppy, no exceptions to this. b. Hypoallergenic Guarantee is only for those who do Not react to a Poodle or Bechon, if Family member Does react to Poodle or Bechon breeds, then no Hypoallergenic Guarantee. It is the responsibility of Purchaser to know breeds their Family member react to or doesn't react to. c. If Allergic reaction does occur after the meeting place of Seller and Purchaser and it is before the 6 hour timeframe, Seller must be notified Immediately, at that time, Seller and Purchaser will drive towards each other for the return of Puppy. A full refund will be given at this point from Seller to Purchaser. d. At deadline of 6 hours, the Hypoallergenic Guarantee is over, no exceptions. We know if a person is going to react to a Puppy, this will be within 30 minutes or less.

6. Treatment Of Puppy: a. Said Puppy will not be Crated, Caged, Shut away in room by itself, tied to stationary object. Cable runs are exceptable if under supervision at all times attached. b. Puppy/Dog will be fed a proper Raw Diet at minimum of 50% of the time. If Dry Kibble is fed it must be a quality kibble, high in Protien and Fat, no corn, soy, grain, wheat. c. Puppy/Dog shall recieve Veterinarian care when needed.

6. Rehoming of Puppy/Dog: a. If Puppy/Dog must be rehomed, new owner Must go through the same approval process as original Purchaser. Happy Bend Kennel must approve new home and have Contract in hand before Puppy/Dog can go to new owners home. b. Purchaser Agrees to Life Long Commitment of said Puppy/Dog. Happy Bend Kennel will not place Puppies in homes to be passed around from home to home.

7. Social Media: Purchaser agrees to Not misrepresent breed of Dog on Social Media, this includes all Family members as well. You agree to represent the breed truthfully, a Australian Indian Dog is just that, not a NAID or Native American Indian Dog or Wolf Dog, Northern breed mix. This includes the use of hash tags as well in this agreement. 8. NuVet Supplements: Purchaser agrees to provide NuVet Plus and NuJoint Plus for the first 2 years of life, starting on the first day in the Home using discount code 40005. Happy Bend Kennel starts all Puppies on these Supplements at 4 weeks of age. Any and All Health Guarantees Void if NuVet Supplements age not given daily (this can be verified with NuVet Labs). 9. Miscellaneous Provisions: a. Merger and Modification: This Document is the entire agreement of the parties. All prior discussions, negotiations and representations are merged within the terms of this Agreement. Do not execute this agreement unless you understand your obligations. Any modification must be in writing and signed by both Purchaser and Seller. b. Choice Of Law: This agreement is enforceable under the laws of the State of Arkansas. c. Venue: Any action for breach of Contract shall be brought in a court of competent jurisdiction in Van Buren County, Arkansas. , and that you submit yourself to the Jurisdiction of that Court. If you alleged that the Seller has breached the Agreement, the lawsuit will be in Clinton, Van Buren County, Arkansas. d. Court cost and Attorney's Fees : If the Court finds that either party has breached this agreement, the Court shall award the non-breaching party it's attorney's fees and Court cost. Executed on the date set forthbelow: e. By signing this legal binding Agreement you are assuming ownership for the life of said Puppy. You are agreeing that said Puppy will never be placed in any type Rescue Facility.
